AS A BUYER

1. BAJAAO Code of Conduct:

BAJAAO respectfully requires that all users of its sites adhere to the following Code of Conduct as a prerequisite to being a member of the BAJAAO community. Anyone who wants to buy or sell on BAJAAO should feel safe and empowered to do so. We want our buyers and sellers to be kind, friendly, and honest and treat all members of our community with dignity and respect.

- Only use the platform if you are over 18 years old or have the supervision of an adult or guardian who is over 18 years old.

- You are solely responsible for your conduct and activities on and regarding to BAJAAO and any and all data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links (together, "Content") that you submit, post, and display on BAJAAO.

- Your Content and your use of BAJAAO shall not be false, inaccurate or misleading, fraudulent or involve the sale of illegal, counterfeit or stolen items.

- You shall not infringe upon any third-party's copyright, patent, trademark, trade secret or other proprietary or intellectual property rights or rights of publicity or privacy.

- You shall not violate any applicable law, statute, ordinance or regulation.

- You shall not sell items that have been identified as hazardous to consumers and therefore subject to a recall.

- Do not use a fake identity.

- Do not create a new or alternate account to avoid restrictions or limitations imposed on another account.

- Do not interfere with other users’ business or listing(s).

- Do not take any transaction off-site, nor encourage anyone to engage in any offsite transaction of any kind.

- Do not share your personal contact or financial information, including phone number, address, email, social media handles, external URLs, banking information, etc., with another BAJAAO user or in any public areas of the site, except as required by law, or as directed by BAJAAO.

- Do not make false claims about other users.

- Always treat other users with respect.

- Do not make threats against BAJAAO or its staff.

- Always treat the BAJAAO staff with respect.

- Always provide accurate personal and contact information in your BAJAAO account.

- Do not engage in any illegal activity, including the infringement of intellectual property, listing items that do not exist or you do not own, shipping items that are different from your listing or the applicable order, money laundering or other forms of fraud.

- Do not engage in discrimination or hate speech of any kind including adverse references to age, race, color, national origin, religion, gender, gender identity, disability, sexual orientation, sexual identity, or pregnancy.

- Do not use the platform to engage in threats of violence or to encourage violence in any manner.

- Do not use the platform to harass, impersonate or intimidate other users.

- Do not use the site to engage in the transmission of pornography or any obscene materials.

Your access to any and all BAJAAO websites is conditioned on your adherence to this policy. Any violation of this section may result in immediate termination of your rights as a BAJAAO user. Determinations will be made at the sole discretion of BAJAAO and may be implemented without warning or the ability to cure.

2. Payment Policy

If you buy an item on BAJAAO, you are obligated to pay for the item that was sold, or one of the series, in a reasonable period of time after the sale. You are solely responsible for payment.

3. Off-Site Transactions/Void Transactions/Fee Avoidance

Any transaction initiated on the Site, but consummated off-site will not be subject to any of BAJAAO's policies or protections.

4. Waiver of Claims

You acknowledge that BAJAAO is only a marketplace that provides a digital connection for users. BAJAAO is not a party to the actual transaction. You expressly waive and release BAJAAO (and BAJAAO's officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with the failure of a user to complete a sale, including a failure by the seller to ship at all or to ship within the stated time period.

5. Order Issues, Cancellations, Returns and Refunds

The buyer has 3 days from delivery to raise a case of Fraud/ Damage in transit or any other issue that is unsatisfactory with the purchased gear.

BAJAAO protects buyers from fraudulent sellers with 3 day fraud protection coverage. Which means that you as a buyer can report a fraudulent claim within 3 days of receiving a product with photo & video evidence, Please shoot a video of live unpacking/ unboxing of product received.

To protect buyers from fraud, sellers must list products using live images taken physically of the product being sold and mention any flaws and issues the gear may have up front at the time of the listing and state the appropriate condition the gear is in. The seller cannot ship a substitute or replacement for the item.

If the Seller has not shipped the sold product within three business days of completing the sale, BAJAAO reserves the right to issue a refund to the buyer on his behalf.
As a seller If you are unable to fulfill an order and must cancel it, or if a buyer requests a cancellation reach out to BAJAAO over the phone or at helpdesk@bajaao.com

If the item is not delivered or not as described (i.e. the item received is significantly different from the listing description based on, make & model appearance, condition, etc). The buyer has three working days to raise a claim and BAJAAO will intervene and resolve the issue.
BAJAAO encourages buyers to contact sellers when any issues or questions arise related to their order, and you should work with the buyer to resolve issues directly. If you are unable to resolve an order issue with a buyer directly, BAJAAO will do all it can to assist.
All payments made for Used gear are held for 3 days from the day of delivery, If a case of Fraud has been raised with us by the Buyer within the 3 day window, BAJAAO will initiate an investigation on the claim and will withhold payment to the seller until the issue is resolved. This may take upto 7 working days. Once a case of fraud or product misrepresentation has been established BAJAAO will refund the payment made back to the Buyer in full after the product has been picked up by a BAJAAO authorized courier to be returned to the seller.

BAJAAO may attempt to resolve disputes at BAJAAO's sole discretion, and BAJAAO has no obligation to resolve disputes between users and outside parties or sale of goods that may have happened outside of the BAJAAO marketplace. Specifically, if the buyer has picked up the product locally and made a payment for the goods directly to the seller instead of going through BAJAAO’s payment gateway; In such cases the 3 day fraud protection will not apply. BAJAAO will attempt to resolve all disputes in good faith based solely on BAJAAO's policies, that BAJAAO may use your personal information for the purpose of resolving a dispute. If willful misrepresentation / fraud is found in certain cases of escalated issues where required, BAJAAO will seek criminal action against the Fraudulent seller and require the buyer to file a FIR raised locally to help resolve such matters.

AS A SELLER

1. BAJAAO Code of Conduct

Nor can you sell certificates of authenticity independent of the actual instrument or gear to which it's attributable.

What can be sold on BAJAAO?

BAJAAO is a unique marketplace for musicians everywhere. Everything listed for sale on BAJAAO caters to music; creating it, playing it, performing it, listening to it and merchandise for music lovers. We think of qualifying items in four broad categories:

- Those you play (and their parts), like instruments, strings, or recording equipment for your vocal instrument!

- Items that that enhance playing, like guitar straps or picks, lesson guides, or pedals

- Items that facilitate creating music or a performance, like mixing boards, amplifiers, lighting equipment, or a drum throne

BAJAAO reserves the right to examine listings and take appropriate action should an item or listing violate BAJAAO’s policies or Terms of Use.

What can't be sold on BAJAAO?

Some items are not allowed to be listed for sale on the BAJAAO marketplace, even if they are instruments or used to make music. This includes prohibited items, and items that otherwise violate BAJAAO’s policies, including the Terms of Use and Intellectual Property policy. By listing an item on the Site you warrant that you and all aspects of the item comply with BAJAAO's published policies.

Hard-drive, USB drive, USB stick, portable disk or any other similar format of digital data storage that contains preloaded sounds, recordings or other media are prohibited on the Site.

2. Listing Standards

In order for BAJAAO to function optimally, BAJAAO sellers must adhere to the following standards governing their listing(s):

- You must legally own the gear you wish to sell.

- You must accurately describe your item and all terms of sale in your gear listing.

- You may not misrepresent the item's location,

- Your item must be accurately described and be authentic. BAJAAO reserves the right to require Certificates of Authenticity (COA), Letters of Authenticity (LOA), or serial numbers, additional Images / Video verification demonstrating that an item is what it is listed to be.

- Your listings may only include text descriptions, pictures and other content relevant to the sale of that item supplied by yourself.

- Your listings may not use stock photography of any kind. Images for listings have to be taken on the BAJAAO app and uploaded by the seller at the time of creating the listing.

- Listings may not include links or reference to other selling venues, external listings, websites or selling channels. The inclusion of phone numbers or email addresses directly in listings, shop banners, or shop policies is prohibited. Any such additions will be removed from the listing by BAJAAO without notice.

- All items must be listed in the appropriate category with appropriate tags.

- Each listing must accurately and completely describe the item/items for sale in that listing.

- Each unique item must have its own listing.

- Your listing shall not promote the sale of gear that display graphic imagery including but not limited to images that denigrate any race, ethnicity, national origin, religion, gender, gender identity, disability, sexual identity, or sexual orientation, unless there is established and recognized historic, artistic, social or political value in the gear or image. BAJAAO will carefully review any such listings in order to provide a fair and reasonable resolution, but BAJAAO retains the sole right to make any final determination on this issue.

- Your listing shall not host images that are not related to a listing.

- Your listing shall not modify, adapt or hack BAJAAO or modify another website so as to falsely misrepresent an association with BAJAAO.

-Your Storefront Name may not contain a name deemed offensive, at BAJAAO's sole discretion.

- The price stated in each item listing description must be an accurate representation of the sale.

- BAJAAO reserves the right to edit or amend listings that violate any of its terms, conditions or policies.

- Sellers may not charge extra shipping fees.

- You may not list or transact on another user's account without permission.

Your access to any and all BAJAAO websites is conditional upon your adherence with these policies. Any violation of this section may result in immediate termination of your accounts and rights as a BAJAAO user. Determinations will be made at the sole discretion of BAJAAO and may be implemented without warning or the ability to cure.

3. Binding Sale and Shipping Obligations

All sales are binding. The seller is obligated to ship the order or otherwise complete the transaction with the buyer in a prompt manner, unless there is an exceptional circumstance, such as:

(a) the buyer fails to meet the terms of the seller's listing (such as payment method), or

(b) the seller cannot authenticate the buyer's identity.

The buyer is obligated to deliver appropriate payment for items purchased, unless there is an exceptional circumstance. By purchasing an item on BAJAAO, the buyer agrees to the specific return and other policies set forth by the individual seller and the seller is obligated to adhere to their return policy.

Both buyer and seller acknowledge and agree that transactions on the Site are between the buyer and seller. The Site exists as the platform for the transaction, but does not make BAJAAO a party to the transaction. Accordingly, BAJAAO retains the right to suspend or terminate a user's privileges for failing to consummate a transaction, but BAJAAO does not have a mechanism to force the completion of a sale or force acceptance of payment. Any failure to complete a binding sale may result in immediate termination of your membership to BAJAAO.

4. Delivery Policy and Refunds/Returns

If you sell an item on BAJAAO, you are obligated to deliver the actual item that was sold, or one of the series, in a reasonable period of time after the sale. You cannot deliver a substitute or replacement item, or withhold delivery, without the express consent of the buyer. If you have not shipped within three business days of completing the sale, BAJAAO reserves the right to issue a refund to the buyer on your behalf. If there are issues with payment, please direct them to BAJAAO Customer Support

BAJAAO encourages buyers to contact sellers when any issues or questions arise related to their order, and you should work with the buyer to resolve issues directly. If you are unable to resolve an order issue with a buyer directly, BAJAAO may be able to assist if the item is not delivered or not as described (i.e. the item received is significantly different from the listing description based on appearance, condition, etc). However, there are some important details to note for specific situations:

- If an item was lost in transit, the seller should work with BAJAAO along with the shipping carrier to file a claim.

BAJAAO may attempt to resolve disputes at BAJAAO's sole discretion, and BAJAAO has no obligation to resolve disputes between users and outside parties. To the extent that BAJAAO attempts to resolve a dispute, BAJAAO will do so in good faith based solely on BAJAAO's policies, and you understand that BAJAAO may use your personal information for the purpose of resolving a dispute.

If you are unable to fulfill an order and must cancel it, or if a buyer requests a cancellation, please keep in mind that cancellations must follow BAJAAO’s policy, including our anti-discrimination policy. Always go through BAJAAO and its processes.

5. Off-Site Transactions/Void Transactions/Fee Avoidance

No sales may be carried out via private message as a means to avoid BAJAAO's sales fee or applicable taxes. Any transaction initiated on the Site, but consummated off-site will not be subject to any of BAJAAO's policies or protections.

6. Shipping Labels

When you purchase a shipping label on BAJAAO, for use, you are responsible for ensuring that all fields are filled out completely and accurately, including size, weight, description (if any) and declared value (if any). Any liability for a failure, or failures, to accurately or appropriately fill out the information will be transferred to you as the user.

You also agree that you will not use a BAJAAO shipping label to send anything harmful or dangerous. You agree to indemnify and hold BAJAAO, its officers, directors, employees, and agents harmless for any claims or damages associated with any breach of this provision.
